The amnesty allows employers to disclose and pay previously unpaid super guarantee charge (SGC), including nominal interest, they owe their employees, for quarter(s) starting from 1\u00a0July 1992 to 31\u00a0March 2018.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Eligible disclosures will not incur the administration component ($20 per employee per quarter) or Part\u00a07 penalty.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, payments of SGC made to the ATO after 24\u00a0May 2018 and before 11.59pm on 7\u00a0September 2020 will be tax deductible.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Employers who have already disclosed unpaid SGC to the ATO between 24\u00a0May 2018 and 6\u00a0March 2020 don\u2019t need to apply or lodge again\u00a0(see\u00a0<\/span><a href=\"https:\/\/www.ato.gov.au\/business\/super-for-employers\/superannuation-guarantee-amnesty\/#DisclosuresofunpaidSGbetween24May2018and\"><span style=\"font-weight: 400;\">Disclosures of unpaid SG between 24\u00a0May 2018 and 6\u00a0March 2020<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Employers who come forward from 6\u00a0March 2020 need to\u00a0<\/span><a href=\"https:\/\/www.ato.gov.au\/business\/super-for-employers\/superannuation-guarantee-amnesty\/#Howtoapplyfortheamnesty\"><span style=\"font-weight: 400;\">apply for the amnesty<\/span><\/a><span style=\"font-weight: 400;\">\u00a0by 7\u00a0September 2020.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ATO will continue to conduct reviews and audits to identify employers not paying their employees SG. If the ATO identify these employers before they come forward, they will not be eligible for the benefits of the amnesty.\u00a0<\/span><\/p>\n<p><b>They will also be required to pay:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">SG shortfall<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">nominal interest (10%)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">administration component ($20 per employee per quarter)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Part\u00a07 penalty (up to 200% of the SGC).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In addition, payments of the SGC won&#8217;t be tax deductible.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Paying super is an important part of being an employer. If you&#8217;re not eligible for the amnesty, or you have unpaid super for quarters that are not eligible, you must still lodge an\u00a0<\/span><a href=\"https:\/\/www.ato.gov.au\/Business\/Super-for-employers\/Paying-super-contributions\/Missed-and-late-payments\/The-super-guarantee-charge-(SGC)\/\"><span style=\"font-weight: 400;\">SGC statement<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Why you should act now<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The ATO&#8217;s ability to identify underpaid SG has increased through greater data visibility as a result of more frequent reporting requirements by super funds and employers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ATO is increasingly using this capability to identify employers that have underpaid SG.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the ATO identify underpaid SG amounts for a quarter that was covered by the amnesty that you have not disclosed, in addition to the SG shortfall you will also be liable for:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the administration component ($20 per employee per quarter)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">up to a 200% Part\u00a07 penalty (at minimum 100% if remission is applicable)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">nominal interest (10%)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the general interest charge (GIC).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In addition, you will not be able to claim a tax deduction for the SGC paid.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Please note amnesty applications must be lodged by the 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> September 2020.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you would like to discuss this amnesty opportunity in greater detail please <a href=\"http:\/\/www.quantumpartners.net.au\/contact-us\/\">contact us today<\/a><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 6 March 2020, the government introduced a super guarantee (SG) amnesty (the amnesty).
