{"id":15477,"date":"2022-03-11T11:09:39","date_gmt":"2022-03-10T23:39:39","guid":{"rendered":"http:\/\/quantiphy.com.au\/oldbackup\/?p=15477"},"modified":"2022-03-14T14:30:38","modified_gmt":"2022-03-14T03:00:38","slug":"superannuation-contributions-removal-of-the-work-test-requirement-from-1-july-2022","status":"publish","type":"post","link":"https:\/\/quantiphy.com.au\/oldbackup\/superannuation-contributions-removal-of-the-work-test-requirement-from-1-july-2022\/","title":{"rendered":"Superannuation Contributions Removal of the Work Test Requirement From 1 July 2022"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A Bill implementing the Government\u2019s key 2021-22 Federal Budget super changes recently passed parliament and received Royal Assent.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regulations have now been registered which remove the existing requirement for a work test (or a work test exemption) to be satisfied for a super fund to accept <\/span><b>mos<\/b><strong>t<\/strong><span style=\"font-weight: 400;\"> types of voluntary contributions made for members aged 67 to 74.\u00a0<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the new rules, which apply for contributions made from 1 July 2022:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">A super fund can accept <\/span><b>most<\/b><span style=\"font-weight: 400;\"> contributions made for a member while they are under age 75 (including the period up to 28 days after the end of the month in which they turn 75), regardless of their work status. This includes downsizer contributions made from the new minimum eligibility age of 60.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">A super fund can only accept mandated employer contributions and downsizer contributions where a member is aged 75 or over (and the 28 day period after the end of the month in which they turn 75 has passed).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The Regulations have clarified that the work test has been removed for <\/span><b>most <\/b><span style=\"font-weight: 400;\">voluntary contributions including:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">non-concessional<\/span><span style=\"font-weight: 400;\"> contributions<\/span><\/li>\n<li><span style=\"font-weight: 400;\">salary sacrifice<\/span><\/li>\n<li><span style=\"font-weight: 400;\">voluntary employer contributions<\/span><\/li>\n<li><span style=\"font-weight: 400;\">lifetime CGT cap contributions<\/span><\/li>\n<li><span style=\"font-weight: 400;\">personal injury payment contributions<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Personal deductible contributions<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The work test <\/span><b>will<\/b><span style=\"font-weight: 400;\"> still apply for these contributions.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Where a member makes a personal contribution on or after 1 July 2022 while aged 67 to 74 (including the period up to 28 days after the end of the month in which they turn 75) which they wish to be a personal tax-deductible contribution, they will still need to satisfy the work test (or work test exemption) during the income year of contribution as a requirement to claim a tax deduction for the contribution.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Bill implementing the
